These Terms and Conditions (“Terms”) govern your use of griffinarts.org (the “Site”) and your participation in programs, membership, sponsorship, and events offered by Griffin Arts Council, Inc. (“GAC,” “we,” “us,” or “our”), a Georgia nonprofit corporation. By using the Site or participating in our programs, you agree to these Terms. If you do not agree, please do not use the Site.

Use of the Site

The Site is provided for informational purposes about GAC’s mission, programs, events, sponsors, and membership. You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of, or restrict or inhibit the use and enjoyment of the Site by, any third party.

You agree not to:

  • Attempt to gain unauthorized access to the Site, our servers, or any systems connected to the Site
  • Use any automated system (bots, scrapers, etc.) to access the Site in a manner that sends more requests than a human could reasonably produce
  • Introduce viruses, malware, or other harmful material through the Site
  • Submit false, misleading, or fraudulent information through our forms

Intellectual Property

All content on the Site, including text, graphics, logos, photographs, artwork, and the GAC name and brush-and-palette mark, is the property of Griffin Arts Council, Inc. or its licensors and is protected by copyright and trademark law, unless otherwise noted. You may view and share content from the Site for personal, non-commercial purposes, but may not reproduce, distribute, or create derivative works from it without our prior written permission.

Artist and community member submissions (such as photos or artwork shared with us for use on the Site or in our marketing) remain the property of their creators. By submitting content to GAC, you grant us a non-exclusive, royalty-free license to use, reproduce, and display that content in connection with promoting GAC’s mission and programs, unless we agree otherwise in writing.

Membership, Sponsorship, and Events

  • Membership benefits, sponsorship packages, event details, ticket prices, and program schedules described on the Site are subject to change without notice.
  • GAC reserves the right to modify, postpone, or cancel any program, event, or membership offering at its discretion, including for reasons of safety, weather, or low enrollment.
  • Where GAC offers paid memberships, sponsorships, tickets, or donations through the Site, payments will be processed by a third-party payment provider. Refund and cancellation terms for a given offering will be stated at the time of purchase; absent a specific stated policy, please contact us to discuss your situation.
  • Donations and membership dues are subject to the terms provided at the time of contribution or enrollment.

User Submissions and Conduct

If we provide ways to submit content (such as contact forms, event RSVPs, or future community submissions), you agree not to submit content that is unlawful, defamatory, obscene, or infringes on the rights of others. We reserve the right to remove or decline to publish any submitted content at our discretion.

The Site may link to or embed third-party services, including social media platforms, mapping services, payment processors, and our email newsletter provider. We do not control and are not responsible for the content, privacy practices, or terms of those third-party services. Your use of them is subject to their own terms and policies.

Disclaimer of Warranties

The Site and its content are provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of accuracy, completeness, or fitness for a particular purpose. We do our best to keep event and program information current but cannot guarantee it is error-free.

Limitation of Liability

To the fullest extent permitted by law, Griffin Arts Council, Inc., its board members, staff, and volunteers will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or participation in GAC programs and events. Nothing in these Terms limits liability that cannot be limited under applicable law.

Assumption of Risk (Events and Programs)

Participation in GAC events, workshops, and programs may involve inherent risks. By attending or participating, you assume those risks to the extent permitted by law. Specific events may require a separate waiver or release, which will be provided at registration when applicable.

Indemnification

You agree to indemnify and hold harmless Griffin Arts Council, Inc. from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or misuse of the Site.

Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Site will be resolved in the state or federal courts located in Spalding County, Georgia.

Changes to These Terms

As GAC introduces new features, such as online membership signup, event ticketing, or donation processing, we will update these Terms to reflect those changes and update the “Last updated” date above. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
